NutriBase End User License Agreement
1. Each copy of NutriBase software is licensed for use by one End User on multiple PC's OR by multiple End Users on a single PC. You can have NutriBase installed on another computer, so long as you are the only person who uses the software. If multiple users are involved, the license applies to one computer only.
2. If additional users wish to use the software, each additional user is required to obtain an Additional User's License from CyberSoft, Inc. This license is available for approximately half the retail cost of the NutriBase software. One Additional User's License is required for each additional user.
3. End User agrees to "register" the software. To register NutriBase, End User is required to send CyberSoft their NutriBase serial number. Upon receipt, CyberSoft will reply with the Registration Key. Every PC you install to will have its own, unique Serial Number. The Serial Number is what we use to generate your Registration Key. A new Registration Key is therefore required for each new PC to which NutriBase is installed.
4. You may not sell, rent, lease, loan, give, sublicense or otherwise transfer the software or any copy of the software in whole or in part to any other person or third party.
5. All sales are final once the Registration Key is issued by CyberSoft, Inc. or 30 days after purchase, whichever comes first.
6. Network Editions are licensed for use on a single server in a single facility. For additional site license information, contact CyberSoft, Inc.
7. CyberSoft will make the current version of NutriBase and the two immediately previous versions of this NutriBase software available for download from our web site. Licensees shall be responsible for creating archival copies of their software in the event of the loss of the original installation file. This means that if you wish to continue using an obsolete version of NutriBase, we highly recommend you make an archival copy so that you will be able to recover from the destruction and/or loss of your obsolete version of NutriBase software.
8. CyberSoft provides licensed users of the Clinical and higher editions of NutriBase the right to sublicense the NutriBase Intake Module for use by their clients on their own computers at no charge.
9. CyberSoft also permits licensed users of NutriBase EZ, Junior, Personal, and Personal Plus to install the Palm Edition of NutriBase onto their own Palm OS-compatible devices. Each Palm PDA is licensed to carrying the data for a single client.
10. Licensed users of NutriBase Clinical Editions may install the NutriBase Palm Edition onto their own Palm OS-compatible devices and onto the Palm-compatible devices of their clients. Each Palm PDA is licensed to carrying the data for a single client.
11. Updates (interim releases within the current version) are free for the version you purchased; upgrades (major new releases) are approximately half price. If you purchase NutriBase within 60 days of a major new release, the new release is a free download.
12. This Software License Agreement is effective upon your installing this program and shall continue until it is terminated. This software license will terminate upon breach of any of the terms and conditions of this Agreement.
13. The software is provided "as is" without warranty of any kind, either expressed or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
14. If you have complied with the terms and conditions of this Agreement, CyberSoft Inc.'s entire liability and your exclusive remedy shall be the replacement of any defective files. In no event shall CyberSoft, Inc. be liable to you for any other damages arising out of your use of this program.

16. In the event of a product return, user is responsible for confirming eligibility with CyberSoft, Inc. Once eligibility is confirmed, user is responsible for insuring the package and acquiring proof of delivery. CyberSoft shall assess a $60 restock/card processing/shipping and handling/invoicing fee ($20 for non-professional versions). Any opened calipers cannot be returned and you will be responsible for the full retail price of these instruments.
